New Industrial Stormwater General Permit Now Available
Deadline to Renew Coverage is September 28, 2022
April 4, 2022 -- The Department of Environment and Energy (NDEE) has issued the National Pollutant Discharge Elimination System (NPDES) Industrial Stormwater General Permit (ISW-GP) NER920000. This general permit authorizes discharges of storm water associated with industrial activities to waters of the State, Municipal Separate Storm Sewer Systems, or Combined Sewer Systems. The permit is applicable statewide to 11 categories of industrial activities. The permit contains provisions that require industrial facilities in 29 different industrial sectors to, among other things, implement control measures and develop site-specific storm water pollution prevention plans (SWPPPs) to comply with NPDES requirements.
The permit became effective April 1, 2022, and expires March 31, 2027. The deadline to renew coverage is September 28, 2022.

Paper Notice of Intent (NOI) and No Exposure Certification (NEC) applications will no longer be available. The direct URL to the application page is:
· Those who have an existing authorization or no exposure certification under ISW-GP NER910000 are required to obtain coverage under NER920000. They should fill out and submit the electronic NOI or NEC.
· New facilities that require coverage should also fill out and submit the NOI. Those who are uncertain if the industrial storm water program applies to their facility should compare the facility’s Standard Industrial Classification (SIC) to those listed in Appendix D.
· Facilities that no longer require coverage or are permanently out of operation need to submit the Notice of Termination (NOT) form.

· Impaired waters are identified in the 2020 Surface Water Quality Integrated Report.
