PUBLIC NOTICE

Notice is given to the public, according to Chapter 10 of Nebraska Administrative Code Title 129 - Nebraska Air Quality Regulations, that the Department is proposing to issue an air construction permit to Pirate Ship LLC (FID 120573) for the construction of an anaerobic digestion and Renewable Natural Gas processing facility (Standard Industrial Classification code 0211) located at 31153 Shiner Bock Road, Haigler, Dundy County, Nebraska. The anticipated change in emissions of regulated air contaminants in tons per year (tpy) due to the proposed construction at this facility will be: 17.68 tpy of Particulate Matter (PM); 17.68 tpy of PM ≤ 10 microns (PM10); 17.68 tpy PM ≤ 2.5 microns (PM2.5); 182.10 tpy Sulfur Dioxide; 158.88 tpy Oxides of Nitrogen; 146.03 tpy Carbon Monoxide; 49.60 tpy Volatile Organic Compounds; 2.43 tpy of Formaldehyde; and 8.75 tpy total Hazardous Air Pollutants (HAP).

Dundy County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. Dundy County meets the state Total Reduced Sulfur (TRS) standards and no significant impact on these standards is expected from this project. No impact is anticipated on habitat for any rare or threatened species.

The Department proposes to issue a construction permit with specific conditions, based on Title 129, which approves the construction of anaerobic digesters, renewable natural gas processing, and anciliary equipment. The project will include a total of twelve (12) anaerobic digesters, three (3) combined heat and power engines, three (3) bypass flares, two (2) compressor engines, eight (8) water heaters, and a back-up well generator.

The proposed permit and supporting materials are available Thursday, September 12th, 2024 through Monday, October 14th, 2024, at the NDEE, 245 Fallbrook Blvd, Suite 100, Lincoln, Nebraska, and electronically at http://dee.ne.gov. Comments received by the Department during this period will be considered prior to the final decision. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing. The request must be in writing and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
