PUBLIC NOTICE

Notice is given to the public, according to Chapter 10 of Nebraska Administrative Code Title 129 - Nebraska Air Quality Regulations, that the Department is proposing to issue an air construction permit to POET Biorefining – Fremont, LLC (FID 86026) an existing ethanol plant to implement monitoring of relief devices associated with protein process operations (Standard Industrial Classification code 2869) located at 1214 Road G Fairmont, Fillmore County, Nebraska. The proposed revision at this facility is not anticipated to result in any change in emissions of regulated air contaminates.

Fillmore County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. No impact is anticipated on habitat for any rare or threatened species.

The Department proposes to issue a construction permit with specific conditions, based on Title 129, which implements monitoring and recordkeeping requirements for relief devices on the ductwork routing emissions from the protein process tanks and equipment (S150) to the thermal oxidizers (Emission Unit S10, which consists of C10A: TO/HRSG #1 and C10B: TO/HRSG #2).

The proposed permit and supporting materials are available Thursday August 8th, 2024 through Monday, September 16th, 2024, at the NDEE, 245 Fallbrook Blvd, Lincoln, Nebraska, and electronically at http://dee.ne.gov. Only comments received by the Department during this period on new and significantly revised conditions to the previous construction permit(s) will be considered. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing. The request must be in writing and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
