Notice is given to the public, according to Chapter 14 of Nebraska Administrative Code Title 129 - Nebraska Air Quality Regulations, that the Department is proposing to issue a construction permit to Heartwell Renewables, LLC (FID 77861) to construct a renewable diesel production facility (Standard Industrial Classification code 2869) located at 505 South Technical Boulevard, Hastings, Nebraska. The anticipated emissions of regulated air contaminants in tons per year (tpy) due to the proposed storage tanks, loading operations, boiler, heaters, flares, cooling tower, firewater pump engines, haul roads, and equipment leaks at this facility will be: 11.25 tpy Particulate Matter (PM); 10.18 tpy PM ≤ 10 microns (PM10); 9.63 tpy PM ≤ 2.5 microns (PM2.5); 81.13 tpy Sulfur Dioxide; 98.87 tpy Oxides of Nitrogen; 90.29 tpy Carbon Monoxide; 90.03 tpy Volatile Organic Compounds (VOC); 5.54 tpy of Hexane; and 10.37 tpy total Hazardous Air Pollutants (HAP).

Adams County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. No impact is anticipated on habitat for any rare or threatened species.

The Department proposes to issue a construction permit with specific conditions, based on Title 129, which establishes operational requirements, including a limit on naphtha loadout for the site flares, requires initial performance testing, and adopts applicable federal regulations.

The proposed permit and supporting materials are available Thursday, September 15, 2022 through Monday, October 17, 2022 at the NDEE, 245 Fallbrook Blvd Suite 100, Lincoln, Nebraska, and electronically at http://dee.ne.gov. Comments received by the Department during this period will be considered prior to the final decision. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing. The request must be in writing and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
