Notice is given to the public, according to Chapter 14 of Title 129 - Nebraska Air Quality Regulations, for a Class I operating permit for Ag Processing Inc (FID # 72698) for the operation of a soybean processing facility (Standard Industrial Classification code 2075) located at 2801 East 7th Street, Hastings, Adam County, Nebraska. The potential emissions of regulated air pollutants (in tons per year (tpy)) at this facility will be: 419.94 tpy of Particulate Matter (PM), 275.55 tpy of PM ≤ 10 microns (PM10), 182.19 tpy PM ≤ 2.5 microns (PM2.5), 224.42 tpy Sulfur Dioxide, 210.00 tpy Oxides of Nitrogen, 275.74 tpy Carbon Monoxide, 884.79 tpy Volatile Organic Compounds, 562.54 tpy Hexane, 36.81 tpy Hydrochloric Acid, 2.84 tpy Hydrofluoric Acid, 600.12 tpy total Hazardous Air Pollutants (HAPs), and 415,274.43 tpy Greenhouse Gases CO2 equivalents (CO2e).

Adams County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. Adams County is unclassifiable in regard to the state Total Reduced Sulfur (TRS) standards and no TRS emissions are expected from this project. No impact is anticipated on habitat for any rare or threatened species.

The Department has reopened operating permit OP00S1-003 for cause in accordance with Title 129, Chapter 15, Section 006. The reason for reopening is that the permit did not contain the correct recording periods of baghouse pressure differential readings for baghouses and the correct list of NSPS requirements for the backup boilers.

The proposed permit and supporting materials are available for inspection by the public June 10, 2020 through July 13, 2020 at the office of the NDEQ, Suite 400, 1200 "N" Street, Lincoln, Nebraska, and electronically at http://deq.ne.gov. Only those provisions that are being revised by this permit action are open for comment at this time. Comments received during this period will be considered prior to the final decision. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing, the request must state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.

Within 60 days after the US Environmental Protection Agency Administrator review, persons may petition the Administrator to object to the issuance of the proposed permit. Any such petition shall be based only on objections to the permit that were raised with reasonable specificity during the 30-day comment period, unless the petitioner demonstrates that it was not practicable to raise such objection within such period.
