PROPOSED RESOURCE CONSERVATION AND RECOVERY ACT (RCRA)
HAZARDOUS WASTE PERMIT RENEWAL FOR
CLEAN HARBORS ENVIRONMENTAL SERVICES, INC. – KIMBALL, NEBRASKA

The Nebraska Department of Environment and Energy (NDEE) is providing public notice of its intent to renew a hazardous waste permit to Clean Harbors Environmental Services, Inc. (CHESI) under the authority of the Nebraska Environmental Protection Act, Neb. Rev. Stat. § 81-1501, et seq. and the Resource Conservation and Recovery Act (RCRA), as amended.

The NDEE has received and reviewed a RCRA hazardous waste permit renew application submitted by CHESI to continue operating an existing hazardous waste storage and treatment/incinerator facility located five miles south of Interstate 80 on Highway 71 in Kimball County, Nebraska.

The permit will allow CHESI to continue to operate a hazardous waste storage and treatment/incinerator facility. The incinerator feed rate will be limited in the permit. The emission rate limits are established for particulate matter, dioxins and furans, metals, hydrogen chloride and chlorine. Operational limits are set on air pollution control equipment, incinerator temperatures and pressures, combustion gas velocity, stack gas flow, total hydrocarbon, oxygen content combustion gases and other parameters that may affect the incinerator performance. Other requirements such as an automatic feed cutoff system, performance testing, inspection, compliance schedule, recordkeeping and reporting are also included in the permit.

The permit will be renewed for a term of 5 years and will supersede NDEE’s previously issued December 1, 2015 portion of the permit (Part I) and the U.S. Environmental Protection Agency (EPA) May 29, 2009 portion of the permit (Part II). The EPA’s May 29, 2009 Part II permit issued to CHESI has been continued since its permit expiration date of May 28, 2019, and the NDEE’s Part I permit has been continued since its expiration date of November 30, 2020. In accordance with Title 40 of the Code of Federal Regulations §270.51(d) and Nebraska Title 128 the EPA’s Part II permit and the NDEE’s Part I permit will remain in effect until the effective date of a new Permit issued by the NDEE.

A copy of the fact sheet, draft permit, administrative record and related correspondence is available for review by any interested parties for a 45-day public comment period from May 12, 2022 to June 26, 2022 at the following locations:

Written comments related to this draft permit must be received by the NDEE postmarked no later than June 26, 2022. If a significant degree of public interest is shown, a public hearing may be held. The comments must be sent to the NDEE, P.O. Box 98922, Lincoln, Nebraska 68509, Attention: Brent L. Luebbe, Engineer, Waste Permits Section.

A public information session has been scheduled for June 14, 2022 at the Kimball Public Library located at 208 South Walnut Street, Kimball, from 7:00 p.m. to 8:30 p.m. Representatives from the NDEE will be available to answer questions that the public may have regarding this permit.

After the public comment period, and public hearing (if held), NDEE will consider all comments that have been received, and the Director will make a final permit decision. Notice of the final decision will be given to the applicant and to each person who submitted comments or requested notice of the final decision. If none of the comments received result in a revision to the draft permit, the permit will become effective immediately upon issuance of the final permit decision. If comments received during the public comment period result in revision(s), the permit will become effective thirty (30) days after service of notice of the final decision to allow for public review of the revisions. The permit may be appealed under Neb. Rev. Stat. § 81-1509.
