Notice is given to the public, according to Chapter 10 of Nebraska Administrative Code Title 129 - Nebraska Air Quality Regulations, that the Department is proposing to issue a construction permit to Waste Management of Nebraska, Inc. (FID# 62593) for the construction of a renewable natural gas plant, replacement of the existing open flare, removal of landfill gas-fired reciprocating internal combustion engines, addition of a fire pump engine, and modification of permitted fuel types for the leachate evaporator system at a municipal solid waste landfill (Standard Industrial Classification code 4953) located at 13505 N 216th St, Bennington, Nebraska. The anticipated change in emissions of regulated air contaminants in tons per year (tpy) due to the proposed project will be: -3.10 tpy of Particulate Matter (PM); -3.11 tpy of PM ≤ 10 microns (PM10); -3.11 tpy of PM ≤ 2.5 microns (PM2.5); -160.60 tpy of Sulfur Dioxide (SOx); -30.19 tpy of Oxides of Nitrogen (NOx); 93.72 tpy of Carbon Monoxide (CO); -60.10 tpy of Non-Methane Organic Compounds/Volatile Organic Compounds (VOCs); -0.22 tpy of Hydrochloric Acid (HCl); -0.77 tpy of Toluene; -3.42 tpy Total Hazardous Air Pollutant, and 61,976.22 tons CO2e/yr Greenhouse Gases.
The project location in Douglas County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. Douglas County meets the state Total Reduced Sulfur (TRS) standards and no significant impact on these standards is expected from this project. No impact is anticipated on habitat for any rare or threatened species.
The Department proposes to issue a construction permit with specific conditions, based on Title 129 amended September 22, 2022, which specifies emission limitations for the renewable natural gas plant, including testing requirements for CO, NOX, and VOC emissions, fuel limitations for natural gas combusted in the thermal oxidizer and off-spec gas combusted in the process flare, and reporting and recordkeeping requirements to demonstrate compliance with these requirements; specifies operational, monitoring, and recordkeeping requirements for the replacement open flare; specifies decommissioning requirements for the landfill gas-fired RICE; specifies federal requirements for the fire pump engines; and specifies a fuel limitation for the addition of natural gas as a permitted fuel type for the leachate evaporator.
The proposed permit and supporting materials are available Friday, August 30th, 2024 through Monday, September 30th, 2024, at the NDEE, 245 Fallbrook Blvd Suite 100, Lincoln, Nebraska, and electronically at http://dee.ne.gov. Comments received by the Department during this period will be considered prior to the final decision. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing. The request must be in writing and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
