NOTICE OF PERMIT ISSUANCE

The Nebraska Department of Environment and Energy (NDEE) proposes to reissue, with change, the National Pollutant Discharge Elimination System (NPDES) General Permit NER210000 for Storm Water Discharges Associated with Construction Sites to waters of the State of Nebraska in accordance to the NDEE Title 119 – Rules and Regulations Pertaining to the Issuance of Permit under the Nation Pollutant Discharge Elimination System. The construction storm water (CSW) permit authorizes discharges from storm water and non-storm water that may transport pollutants associated with both small and large construction activity. This permit provides coverage from construction and support activity that causes land disturbance of equal to or greater than one acre and less than one acre if the construction activity is part of a common plan of development or sale. Covered construction activity includes a disturbance to land that results in a change in the land topography or existing soil cover (both vegetative and non-vegetative) that may cause storm water runoff sediment from erosion or other pollutants to be transported into the waters of the state or urban drainage systems. The permit would be issued for a period of up to five years and would restrict pollutant discharges to comply with the requirements of Department regulations. The draft permit, fact sheet, and other public information are available for review and copying at NDEE’s Lincoln Office, 245 Fallbrook Boulevard, Lincoln, Nebraska 68521 between 8:00 a.m. and 5:00 p.m. (CT), weekdays, excluding holidays. Written comments, objections, and/or hearing requests concerning permit issuance may be submitted to Kim Bubb, NPDES and State Permits Section, Nebraska Department of Environment and Energy, PO Box 98922, Lincoln, NE 68509-8922, before the comment period ending date of September 23, 2021. A determination to hold a hearing will be based upon factual environmental or regulatory consideration.

NDEE will send a letter notifying facilities when this permit has been issued. Once this permit is issued, facilities may submit applications to be covered under the permit
