Notice is given to the public, according to Chapter 10 of Nebraska Administrative Code Title 129 - Nebraska Air Quality Regulations, that the Department is proposing to issue an air construction permit to Omaha Papillion Creek Wastewater Treatment Plant (FID 57789), a wastewater treatment facility (Standard Industrial Classification code 4952 – Sewerage Systems) located at 15705 Harlan Lewis Road, Bellevue, Sarpy County, Nebraska. There is no anticipated change in emissions of regulated air contaminates due to the proposed revision.

Sarpy County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. No impact is anticipated on habitat for any rare or threatened species.

The Department proposes to reopen construction permit CP21-039 for cause in accordance with Title 129, Chapter 15, Section 006. The reason for reopening the permit is to re-establish three (3) existing engines with previously permitted emission limitations and operating requirements that had been removed in CP21-039 as well as add new decommissioning conditions.

The proposed permit and supporting materials are available Monday, May 22, 2023 through Wednesday, June 21, 2023 at the NDEE, 245 Fallbrook Blvd, Suite 100, Lincoln, Nebraska, and electronically at http://dee.ne.gov. Only comments received by the Department during this period on new and significantly revised conditions to the previous construction permit(s) will be considered. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing. The request must be in writing and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
