PUBLIC NOTICE OF PUBLIC HEARING

On August 31, 2022 notice was given to the public of the Nebraska Department of Environment and Energy’s (NDEE) intent to issue a Construction Permit to Omaha Public Power District – Turtle Creek Station (NDEE Facility ID #116017) for an electric generation facility (SIC Code 4911) located at 14601 South 168th Street, Gretna, Sarpy County, Nebraska. That public notice was provided in accordance with Chapter 14 of Nebraska Administrative Code Title 129 – Nebraska Air Quality Regulations (Title 129).

During the comment period a public hearing was requested.

Notice is now given pursuant to Title 129, Chapter 14, Section 005, and Title 115 – Rules of Practice and Procedure, that the NDEE will hold a public hearing on the proposed permit. The public hearing will be held on Thursday, October 13, 2022, beginning at 6:00 P.M. at the Holiday Inn Express and Suites, located at 16175 Stevens Point Circle, Gretna, Nebraska. Preceding the hearing, representatives of the NDEE will hold an information session from 4:00 to 5:00 P.M. to answer questions from the public related to the proposed permit. Comments received during the informational meeting will not be part of the administrative record. The comment period is also hereby extended and written comments received by NDEE prior to 5:00 P.M. CT on Wednesday, October 12, 2022, will be considered in the final decision on the proposed permit. Written comments received after October 12, 2022, will not be considered unless submitted at the public hearing.

All interested persons may attend and testify verbally or by written submission at the public hearing. Interested persons should provide notice in advance to attend or testify at the public hearing by contacting the Air Quality Construction Permits Section at: via email to NDEE.airquality@nebraska.gov, via mail to P.O. Box 98922, Lincoln, NE 68509-8922, or by telephone at (402) 471-2189, not later than 5:00 P.M. CT, October 12, 2022.

The proposed permit and supporting materials are available for inspection at the office of the NDEE, Suite 100, 245 Fallbrook Boulevard, Lincoln, Nebraska, and electronically at http://dee.ne.gov.

All persons, including the applicant, who believe any condition of the draft permit is inappropriate or that the Director’s tentative decision to issue the air quality construction permit is inappropriate, must raise all reasonably ascertainable issues and submit all reasonably available arguments supporting their position by the close of the public hearing.
