Notice is given to the public, according to Chapter 10 of Nebraska Administrative Code Title 129 - Nebraska Air Quality Regulations, that the Department is proposing to issue an air construction permit to Ag Processing Inc, A Cooperative (FID 118545) for the construction of a soybean oil extraction facility (Standard Industrial Classification code 2075) located at 3641 M Rd, David City, Nebraska. The anticipated change in emissions of regulated air contaminants in tons per year (tpy) due to the proposed construction at this facility will be: 158.41 tpy of Particulate Matter (PM); 152.12 tpy of PM ≤ 10 microns (PM10); 60.04 tpy PM ≤ 2.5 microns (PM2.5); 1.81 tpy Sulfur Dioxide; 143.26 tpy Oxides of Nitrogen; 98.93 tpy Carbon Monoxide; 784.32 tpy Volatile Organic Compounds; 779.63 tpy of Hexane; 779.74 tpy total Hazardous Air Pollutants (HAP); and 178,177 tpy Greenhouse Gases CO2 equivalents (CO2e).


Butler County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. No impact is anticipated on habitat for any rare or threatened species.

The Department proposes to issue a construction permit with specific conditions, based on Title 129, which permits the construction of soybean oil extraction facility which includes raw soybean receiving, soybean preparation, oil extraction, meal and hull pelletizing, loadout, cooling towers, and emergency equipment. Particulates generated from soybean processes will be controlled by baghouses and cyclones. Solvent from soybean oil extraction will be controlled by a mineral oil absorption.

The proposed permit and supporting materials are available Thursday, May 18, 2023 through Monday, June 19, 2023 at the Hruska Memorial Public Library, at the NDEE, 245 Fallbrook BLVD, STE 100, Lincoln, Nebraska, and electronically at http://dee.ne.gov. Comments received by the Department during this period will be considered prior to the final decision. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing. The request must be in writing and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
