NOTICE OF INTENT TO ISSUE PERMIT #NE0204412


for the Rainwood Road Construction & Demolition Waste Disposal Area
under consideration by the
Nebraska Department of Environment & Energy

PUBLIC NOTICE is given in accordance with Title 132 - Integrated Solid Waste Management Regulations, Chapter 2, §011, that the Nebraska Department of Environment & Energy (NDEE) has received an application to renew the permit for the Rainwood Road C&D Landfill Construction and Demolition Waste Disposal Area, 12221 Rainwood Road, Omaha, NE. After review of the permit application, a preliminary determination has been made to recommend renewal and modification of the permit. The term of the permit shall be September 8, 2022 through September 7, 2027.

FACILITY DESCRIPTION. The permit allows the operation of an existing Construction and Demolition Waste Disposal Area under Nebraska's solid waste management laws and regulations. The construction and demolition waste disposal area shall accept waste which results from land clearing, the demolition of buildings, roads, or other structures, including but not limited to, fill materials, wood, land clearing debris, other yard waste, wall covering, drywall, plaster, non-asbestos insulation, roofing shingles, and other roof coverings, plumbing fixtures, glass, plastic, carpeting, electrical wiring, pipe, and metals.

MAJOR MODIFICATION. The major modification includes a lateral expansion to the south of the existing landfill area and a vertical expansion over the existing landfill area. The modification increases the waste disposal area by 7.5 acres, modifies final cover contours, and increases the life of the waste disposal area.

FACILITY LOCATION. The property is located at 12221 Rainwood Road, Omaha, NE. The legal description of the Rainwood Road C&D Landfill Construction and Demolition Waste Disposal Area is part of Sections 19 Township 16 North Range 12 East of the 6th Principal Meridian Douglas County, Nebraska.

OPPORTUNITY FOR PUBLIC COMMENT AND HEARING. The public may submit written comments and may also request a public hearing on the permitting decision. A request for a hearing must be made in writing and state the issues proposed for discussion and their relation to the proposed permit renewal. The NDEE will make a final decision to issue or deny the permit based on the permit application, the compliance status of Rainwood Road C&D Landfill Construction and Demolition Waste Disposal area, and public comment received. NDEE will notify the applicant and other interested persons.

COMMENT PERIOD. All comments or requests for a hearing must be postmarked by June 14, 2022.
