NOTICE OF INTENT TO SUSPEND PERMIT #NE0203904


for Anderson Excavating Company Calhoun Round Construction & Demolition Landfill
under consideration by the
Nebraska Department of Environment & Energy

PUBLIC NOTICE is given in accordance with Title 132 - Integrated Solid Waste Management Regulations, Chapter 2, §011, that the Nebraska Department of Environment & Energy (NDEE) has decided to suspend the permit for Anderson Excavation, Inc. 1920 Dorcas St., Omaha, NE for the operation of the Calhoun Road Construction & Demolition Waste Disposal Area. After the facility was unable to reestablish financial assurance, a preliminary determination has been made to suspend permit NE0203904.

FACILITY DESCRIPTION. Permit NE0203904 allows for the operation of an existing construction and demolition waste disposal area under Nebraska's solid waste management laws and regulations. The permit was issued on May 16, 2019, with a duration of 5 years. The permit suspension shall remain in place until the facility re-establishes financial assurance, the term of the permit expires, or the facility permanently closes, whichever occurs first.

FACILITY LOCATION. The property is located at 13707 Calhoun Road, Omaha, NE which is north of Omaha on Highway 75. The legal description of the Anderson Excavating, Inc. Calhoun Road Construction & Demolition Waste Disposal Area is NW ¼ SW ¼ Section 9 Township 16 North Range 13 East of the 6th Principal Meridian Douglas County, Nebraska.

OPPORTUNITY FOR PUBLIC COMMENT AND HEARING. The public may submit written comments and may also request a public hearing on the permitting decision. A request for a hearing must be made in writing and state the issues proposed for discussion and their relation to the proposed permit suspension. Public comments and hearing requests shall be made to: NDEE.solidwaste@nebraska.gov or Nebraska Department of Environment & Energy P.O. Box 98922, Lincoln, NE 68509-8922, attention Daniel LeMaistre, Waste Permit Section Supervisor.

The NDEE will make a final decision whether to not suspend the permit based or allow for continued operations of the facility based on the ability for Anderson Excavating Inc. to reestablish financial assurance, and public comment received. NDEE will notify the applicant and other interested persons.

COMMENT PERIOD. All comments or requests for a hearing must be received by December 15, 2021.
