Notice is given to the public, according to Chapter 14 of Nebraska Administrative Code Title 129 - Nebraska Air Quality Regulations, that the Department is proposing to issue an air construction permit to Norfolk Crush, LLC (FID 117703) for construction of a soybean oil extraction facility (Standard Industrial Classification code 2075 – Soybean and Other Oilseed Processing) located at 3820 North 1st Street, Norfolk, Madison County, Nebraska. The anticipated change in emissions of regulated air contaminants in tons per year (tpy) due to the proposed construction at this facility will be: 134.94 tpy of Particulate Matter (PM); 86.01 tpy of PM ≤ 10 microns (PM10); 77.74 tpy PM ≤ 2.5 microns (PM2.5); 0.97 tpy Sulfur Dioxide; 29.07 tpy Oxides of Nitrogen; 30.71 tpy Carbon Monoxide; 550.00 tpy Volatile Organic Compounds; 544.64 tpy of Hexane; and 544.79 tpy total Hazardous Air Pollutants (HAP).

Madison County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. No impact is anticipated on habitat for any rare or threatened species.

The Department proposes to issue a construction permit with specific conditions, based on Title 129, which permits the construction of soybean oil extraction facility which includes raw soybean receiving, soybean preparation, oil extraction, meal and hull shipping, cooling tower, and emergency equipment. Particulates generated from soybean processes will be controlled by baghouses, cyclones, and/or mineral oil suppression. Solvent from soybean oil extraction will be controlled by a mineral oil absorption and a leak detection and repair program.

The proposed permit and supporting materials are available Thursday, September 22, 2022 through Monday, October 24, 2022 at the Norfolk Public Library, at the NDEE, 245 Fallbrook Blvd, STE 100, Lincoln, Nebraska, and electronically at http://dee.ne.gov. Only comments received by the Department during this period on new and significantly revised conditions to the previous construction permit(s) will be considered. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing. The request must be in writing and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
