Title 122 - Rules and Regulations for Underground Injection and Mineral Production Wells
Chapter 8 - Area Permits

001 The Director may issue an area permit on an area basis rather than for each well individually, provided that the area permit is for injection wells and/or mineral production wells:

001.01 Described and identified by location in permit application(s), if they are existing wells;

001.02 Within the same well field, facility site, reservoir, project, or similar unit in the same State;

001.03 Of similar construction;

001.04 Of the same class as determined under Chapter 2 of this Title; and

001.05 Operated by a single owner or operator.

002 Area permits shall specify:

002.01 The area within which underground injections are authorized;

002.02 The requirements for construction, monitoring, reporting, operation, and abandonment, for all wells authorized by the area permit; and

002.03 The requirements for aquifer restoration.

003 The area permit may authorize the permittee to construct and operate new injection wells and/or mineral production wells within the permit area provided:

003.01 The permittee notifies the Director no later than the date on which monitoring reports are required to be submitted under Chapter 20 of this Title, pursuant to a procedure which shall be specified in the area permit, when and where the new well will be drilled;

003.02 Plans and specifications are submitted with notification and approved by the Department;

003.03 The additional well satisfies the criteria in section 001 of this Chapter and meets the requirements specified in the area permit under section 002 of this Chapter; and

003.04. The cumulative effects of drilling and operation of additional injection wells and/or mineral production wells are considered by the Director during evaluation of the area permit application and are acceptable to the Director.

004 If the Director determines that any well constructed pursuant to section 003 of this Chapter does not satisfy all of the requirements of sections 003.01, 003.02 and 003.03 of this Chapter the Director may modify the area permit under Chapter 30 of this Title, terminate the area permit under Chapter 31 of this Title, or take enforcement action. If the Director determines that cumulative effects are unacceptable, the area permit may be modified under Chapter 30 of this Title.
