Air Construction Permit Fee

Must accompany each application for an air quality construction permit, which are based on the potential amount of the facility’s emissions.

What it is
Each application for an air quality construction permit must be accompanied by a fee in accordance with the schedule shown below. The schedule is based on the facility-wide potential to emit.

How the fee is used

Air Emissions Fee for Major Sources

All major sources of air emissions are assessed air emissions fees, which are based upon the facility’s actual air emissions.

What it is
A fee based on actual emissions from major (also known as Title V or Class I) industrial air emission sources. The Air Division provides the major source an invoice of the fees due based upon its actual emissions reported in their annual emission inventory report.


How the fee is used
The fees collected are used to support the Air Division’s permitting and compliance programs for major air emission sources and air emission sources that have taken limitations to avoid major source classification.

Chemigation Permit Fees

For an initial application for a chemigation permit or special permit regarding fertilizer or pesticides being applied through an irrigation system.

Hazardous Waste Treatment or Disposal Fee

Assessed annually for all waste treated or disposed of at a permitted hazardous waste treatment or disposal facility based on the type of treatment or disposal performed.

What it is
A fee is assessed annually for all waste treated or disposed of at a permitted hazardous waste treatment of disposal facility. The fee is assessed based on the type of treatment or disposal performed.


How the fee is used
This fee is remitted to the State Treasurer and credited to the General Fund.

Landfill Disposal Fee

A fee of $1.25 per ton fee is assessed for all waste disposed in municipal solid waste landfills.

What it is
A fee of $1.25 per ton fee is assessed for all waste disposed in municipal solid waste landfills.


How the fee is used
Fifty percent goes to DEE’s Waste Reduction and Recycling Grants Program as a source of grants for local recycling and waste reduction projects. Fifty percent is used to support the operating costs of the Integrated Waste Management program.

Litter Fee - Annual

Assessed on all manufacturers, retailers and wholesalers of products, which are deemed to directly contribute to the litter stream.

What it is
Fee on all manufacturers, retailers and wholesalers of products, which are deemed to directly contribute to the litter stream. A list of products is in statute. Link to §81-1560 * Fee is $175.00 per each $1 million dollars of gross sales of these products only.


How the fee is used
This goes to DEE’s Waste Reduction and Recycling Grants Program as a source of grants for local recycling and waste reduction projects.

Livestock Waste Control Program Fees (LWCP)

Three fees are associated with this program:
  1. initial inspection,
  2. permit application fee, and
  3. annual permit fee.



1. LWCP - Initial Inspection Fee

A fee must accompany all requests by animal feeding operations (AFO) for an initial inspection of the operation’s livestock waste control facility (LWCF) or the proposed site of the LWCF.

What it is
All medium and large animal feeding operations must request an initial inspection of its existing and proposed operation, if not previously inspected by the Department. An initial inspection must be done prior to the start of any construction, and prior to the submittal of an application for a construction and operating permit. An existing operation that has not requested an initial inspection is subject to late fees. The amount of the initial inspection fee required varies with the livestock capacity of the AFO:

2. LWCP - Permit Application Fee

An application fee of $200 per permit must accompany the application for a Construction and Operating Permit, a National Pollutant Discharge Elimination System (NPDES) permit, or a major modification of either permit type.

What it is
An AFO must submit a permit application if the Department determines that a permit for livestock waste control facilities is required. An operation may be required to obtain a Construction and Operating Permit, or a NPDES permit, or both permits.


How the fee is used
This application fee is used to support the operating costs of the Livestock Waste Control Program in regulating the storage and disposal of livestock waste in Nebraska.

3. LWCP - Annual Permit Fee

A fee due annually by March 1, required from all large animal feeding operations that had a permit and all NPDES permit holders as of December 31 of the previous year.

What it is
An annual permit fee is assessed to permitted Large Concentrated Animal Feeding Operations (CAFOs) and any animal feeding operation with an active National Pollutant Discharge Elimination System permit as of the previous December 31. The annual fee rate varies per species and may be adjusted year to year, although it has remained the same for 2008 and 2009. See Fact Sheet, AFO Categories and Fees for specific information to help determine the total fee for each livestock species for which your operation has a permit.


How the fee is used
The annual fee is used to pay a portion of the costs of the Livestock Waste Control Program. Approximately 20% of the operating costs of the program must come from fees. The annual permit fee rate may be adjusted annually to ensure fees provide 20% of program costs.

Onsite Wastewater

(Includes Septic Systems, Private Lagoons, Holding Tanks)
Professional Certification and System Registration Fees, and Application Fess for Permits and Subdivision Reviews and Approvals

Certification fees are assessed to those who perform work on septic systems, private lagoons, and other onsite systems; registration fees are assessed on any modification or construction of an onsite system; application fees are required with permit applications for onsite systems subject to a permit; and application fees are required with applications for subdivision review and approval. Fees are nonrefundable. Any local government requirements are separate and may also apply

What they are

Certification fees

Anyone who performs work (percolation testing, pumps, installs, repairs, or inspects) on private onsite wastewater treatment systems is required to be certified by examination by the Nebraska Department of Environment & Energy unless they are a professional engineer or a registered environmental health specialist. Certification categories include Master and Journeyman Installer, Soil Evaluator, Inspector, Master and Journeyman Pumper. A qualified professional is required to be at the job site whenever work is being conducted on an onsite system.


Registration fees

Any construction or modification of an onsite system (i.e., septic system, household lagoon, holding tank, or engineered system) must be registered with the NDEE A $140 fee is required for each system registration. Any registration submitted 46 to 90 days after completion of construction or modification is subject to a $150 late fee. Any registration submitted 91 or more days after completion of the system is subject to a $450 late fee.


Permit Application Fee

For an onsite wastewater treatment system for domestic wastewater flows of 1,000 gallons per day or more, or for other than household type wastes, or for a system not provided for in “Authorization by Rule” (see Title 124, Ch. 3, Section 002) a permit application is required. Plans and technical documents must be prepared by a Professional Engineer. The construction/operating permit application fee is $450 and the one fee covers the construction and operating permit application for one system. A construction permit from the Department is required prior to any construction and an operating permit is required prior to operation.


Subdivision Review and Approval Application Fee

Prior to construction of a development area where an onsite wastewater treatment system is proposed on any lot less than three acres in size, the owner of the development area is required to submit an application for subdivision review and receive Department approval. Site layout must be completed by a qualified professional (Master or Journeyman Installer or Professional Engineer). The application fee is $450 for each lot that is subject to the approval.

Petroleum Release Remedial Action Fee

Used to support the agency activities primarily involved in cleaning up releases of petroleum.

What it is
A $90 fee per registered underground tank storing petroleum is collected through the State Fire Marshall’s office. A fee on each gallon sold ($0.009 on gasoline and $0.003 on diesel) is collected by the Nebraska Department of Revenue.


How the fee is used
The fees are used by the Petroleum Remediation Section to investigate and clean up releases of petroleum to the soil and ground water. Some financial assistance is provided to persons responsible for cleaning up their sites, and orphan sites (responsible person is unknown) are cleaned up by the Department.

Solid Waste Management Annual Operating Fee

Assessed for the operation of any solid waste management facility.

What it is
A set fee for operating any solid waste management facility. These include: municipal solid waste landfills, industrial waste landfills, construction and demolition waste landfills, fossil fuels combustion ash disposal landfills, compost facilities, materials recovery facilities, delisted hazardous waste disposal landfills, and transfer stations.


How the fee is used
This fee is used to support the operating costs of the Integrated Waste Management program.

Integrated Solid Waste Management Permit Application Fee

A set fee is assessed for all solid waste management facilities when they apply for their required permit.

What it is
A set fee is assessed for any solid waste management permit activity. These include: municipal solid waste landfills, industrial waste landfills, construction and demolition waste landfills, fossil fuels combustion ash disposal landfills, compost facilities, materials recovery facilities, delisted hazardous waste disposal landfills, and transfer stations. Permit application fees apply to new facilities, major modification to an existing facility, and renewal of the permit for an existing facility.


How the fee is used
This fee is used to support the operating costs of the Integrated Waste Management program.

Tire Fee - New

A $1 fee is charged on each new tire sold in Nebraska.

What it is
A fee of $1.00 charged on each new tire sold in Nebraska.

Waste Reduction & Recycling Fee - Annual

A fee of $25 is assessed to all retail businesses in Nebraska with sales of at least $50,000 or more and used as a source of grants for local recycling and waste reduction projects.

What it is
$25.00 fee on all retail businesses in Nebraska with sales of at least $50,000.00 or more.


How the fee is used
This goes to DEE’s Waste Reduction and Recycling Grants Program as a source of grants for local recycling and waste reduction projects.
