PUBLIC NOTICE

Notice is given to the public, according to Chapter 10 of Nebraska Administrative Code Title 129 - Nebraska Air Quality Regulations, that the Department is proposing to issue an air construction permit to Christensen Brothers Partnership, LLP (FID 73859) a hog confinement facility for the installation of a new incinerator (Standard Industrial Classification code 0213) located at 55450 873 Rd, Randolph, Cedar County, Nebraska. The anticipated change in emissions of regulated air contaminants in tons per year (tpy) due to the proposed construction at this facility will be: 2.23 tpy of Particulate Matter (PM); 2.23 tpy of PM ≤ 10 microns (PM10); 2.23 tpy PM ≤ 2.5 microns (PM2.5); 5.55 tpy Sulfur Dioxide; 9.77 tpy Oxides of Nitrogen; 7.89 tpy Carbon Monoxide; 0.78 tpy Volatile Organic Compounds; 0.02 tpy of Hydrogen Fluoride; and 0.93 tpy total Hazardous Air Pollutants (HAP).

Cedar County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. No impact is anticipated on habitat for any rare or threatened species.

The Department proposes to issue a construction permit with specific conditions, based on Title 129, which approves the construction of a new animal carcass incinerator with the capacity to incinerate of 1,147 pounds per hour. The incinerator is required to be equipped with an afterburner control device and performance testing is required to demonstrate compliance with Title 129, Chapter 14 emission standards for incinerators.

The proposed permit and supporting materials are available Thursday, July 25th, 2024, through Monday, August 26th, 2024, at the NDEE, 245 Fallbrook Blvd, Suite 100, Lincoln, Nebraska, and electronically at http://dee.ne.gov. Comments received by the Department during this period will be considered prior to the final decision. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing. The request must be in writing and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
