PROPOSED RESOURCE CONSERVATION AND RECOVERY ACT (RCRA)
HAZARDOUS WASTE PERMIT CLASS 3 PERMIT MODIFICATION FOR
CLEAN HARBORS ENVIRONMENTAL SERVICES, INC. – KIMBALL, NEBRASKA

The Nebraska Department of Environment and Energy (NDEE) is providing public notice of a Class 3 permit modification for Clean Harbors Environmental Services, Inc. (CHESI) hazardous waste permit issued under the authority of the Nebraska Environmental Protection Act, Neb. Rev. Stat. § 81-1501, et seq. and the Resource Conservation and Recovery Act (RCRA), as amended, in response to a Class 3 permit modification requested by CHESI.

The NDEE has received and reviewed the Class 3 permit modification requested by CHESI to add a hazardous waste incinerator, container and tank storage, miscellaneous units, laboratories, associated air pollution control equipment, and to modify other parts of the permit application related to the addition of hazardous waste management units, to include: the RCRA Part A application, facility description, waste characterization, waste analysis plan, container report, tank systems, miscellaneous units, secondary containment, drawings, fugitive emissions, hazard prevention, inspection plan, contingency plan, closure plan, and closure cost estimate. This hazardous waste permit Class 3 permit modification submitted by CHESI is for modification of the existing hazardous waste storage and treatment/incinerator facility located five miles south of Interstate 80 on Highway 71 in Kimball County, Nebraska.

A copy of the administrative record, which includes the draft modified permit, fact sheet, modification summary, and related correspondence, is available for review by any interested parties for a 45-day public comment period from May 23, 2024 to July 7, 2024 at the following locations:

Written comments related to this hazardous waste permit modification must be received by the NDEE postmarked no later than July 7, 2024. If a significant degree of public interest is shown, a public hearing may be held. The comments must be sent to the NDEE, 245 Fallbrook Blvd., Suite 100, Lincoln, Nebraska 68521, Attention: Daniel LeMaistre, Waste Permits Section Supervisor.

A public information session has been scheduled for June 17, 2024 at the Kimball Public Library located at 208 South Walnut Street, Kimball, from 7:00 p.m. to 8:30 p.m. Representatives from the NDEE will be available to answer questions that the public may have regarding this permit modification.

After the public comment period, and public hearing (if held), NDEE will consider all comments that have been received, and the Director will make a final permit decision. Notice of the final decision will be given to the applicant and to each person who submitted comments or requested notice of the final decision. If none of the comments received result in a revision to the draft permit, the permit will become effective immediately upon issuance of the final permit decision. If comments received during the public comment period result in revision(s), the permit will become effective thirty (30) days after service of notice of the final decision to allow for public review of the revisions. The permit may be appealed under Neb. Rev. Stat. § 81-1509.
