Notice is given to the public, according to Chapter 14 of Title 129 – Nebraska Air Quality Regulations as amended March 29, 2020 and Chapter 10 of Title 129 - Nebraska Air Quality Regulations as amended September 28, 2022, that the Department is proposing to issue a Class I operating permit to Tyson Fresh Meats, Inc. (FID# 07339) for operation of a beef processing and hide tanning plant, which also includes a wastewater treatment plant (Standard Industrial Classification code, 2077) located at 1131 Dakota Avenue, Dakota City, Dakota County, Nebraska. The potential emissions of regulated air pollutants (in tons per year (tpy)) at this facility will be: 174.70 tpy of Particulate Matter (PM), 174.70 tpy of PM ≤ 10 microns (PM10), 174.70 tpy PM ≤ 2.5 microns (PM2.5), 81.34 tpy Sulfur Dioxide, 239.94 tpy Oxides of Nitrogen, 323.01 tpy Carbon Monoxide, 38.99 tpy Volatile Organic Compounds, 6.65 tpy of Hexane (largest quantity individual Hazardous Air Pollutant (HAP), 7.01 tpy total HAPs, and 383,686.65 tpy Greenhouse Gases CO2 equivalents (CO2e).

Dakota County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. Dakota County is unclassifiable in regard to the state Total Reduced Sulfur (TRS) standards and no significant impact on these standards is expected from this project. No impact is anticipated on habitat for any rare or threatened species.

The NDEE proposes to issue a Class I operating permit with specific conditions, based on Title 129, which authorizes requirements for control equipment (baghouses, scrubbers, flare) for various process equipment; specifies emission limits for various equipment; specifies requirements from federal NSPS rules (40 CFR 60) for Subparts A, Dc and IIII; specifies requirements from federal NESHAP rules (40 CFR 63) for Subparts A, ZZZZ, JJJJJJ and CCCCCC; specifies testing requirements for various equipment; specifies inspection, operation, maintenance, and monitoring requirements (including Continuous Emissions Monitoring Systems); and specifies recordkeeping and reporting requirements.

The proposed permit and supporting materials are available for inspection by the public Tuesday, May 21, 2024 through Friday, June 21, 2024 at the office of the NDEE, 245 Fallbrook Boulevard, STE 100, Lincoln, Nebraska, and electronically at Comments received during this period will be considered prior to the final decision. Any such petition shall be based only on objections to the permit that were raised with reasonable specificity during the 30-day comment period, unless the petitioner demonstrates that it was not practicable to raise such objection within such period.
