Local Siting Approval of Solid Waste Management Facilities
The Local Siting Act (Neb. Rev. Stat. Sections 13-1701 to 13-1714 and Neb. Rev. Stat. Section 13-2035) provides clear legislative instruction for the initial siting of new facilities and creates procedural requirements for local governments to administer. The act excludes those facilities applying for permit renewal.
It is the Nebraska Department of Environment and Energy’s position that local governments are better situated to evaluate the applicability of these requirements to local projects, including those projects that are not an initial siting (i.e. permit modifications for lateral expansion).

Pursuant to Title 132 - Integrated Waste Management Regulations, Chapter 2, §006.01H the department must receive documentation of local siting approval. In order to avoid delays in issuing new or modified permits, the attached certification form should be completed and submitted as part of a permit application.
