Notice is given to the public, according to Chapter 10 of Nebraska Administrative Code Title 129 - Nebraska Air Quality Regulations, that the Department is proposing to issue an air construction permit to JWC Gburg LLC (FID-120154) to construct new fertilizer production facility (Standard Industrial Classification code (2873) located at the intersection of Highway 30 and County Road 413, Gothenburg, Dawson County, Nebraska. The anticipated change in emissions of regulated air contaminants in tons per year (tpy) due to the proposed at this facility will be: 43.17 tpy of Particulate Matter (PM); 18.19 tpy of PM ≤ 10 microns (PM10); 8.73 tpy PM ≤ 2.5 microns (PM2.5); 0.06 tpy Sulfur Dioxide; 86.43 tpy Oxides of Nitrogen; 11.52 tpy Carbon Monoxide; 7.08 tpy Volatile Organic Compounds; 0.19 tpy of Hexane; and 1.19 tpy total Hazardous Air Pollutants (HAP).
Dawson County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. No impact is anticipated on habitat for any rare or threatened species.
The Department proposes to issue a construction permit with specific conditions, based on Title 129, which approves the construction of an ammonium nitrate fertilizer production plant. The intermediary nitric acid productions steps are subject to federal rules which include emission standards and continuous monitoring.
The proposed permit and supporting materials are available Wednesday, June 12, 2024 through Friday, July 12, 2024 at the NDEE, 245 Fallbrook Blvd, STE 100, Lincoln, Nebraska, and electronically at http://dee.ne.gov. Comments received by the Department during this period will be considered prior to the final decision. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing. The request must be in writing and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
