NESHAP M is a rule that is part of the Air Toxics program. Details about this regulation can be found in the Code of Federal Regulations at 40 CFR Part 61 Subpart M. This form is designed to fulfill the notification requirements for demolition and renovation projects. For regulated entities that must submit this form in accordance with NESHAP M, the form must be submitted to NDEE at least 10 working days prior to asbestos removal or site preparation. If no asbestos is present, the form must be submitted at least 10 working days before demolition begins. This form must be submitted to both NDEE and DHHS.
Note: Effective Oct. 1, 2009, any individual submitting any application or form that would derive public benefit from the state must also fill out a United States Citizenship Attestation form.
